Community right to bid

The Community Right to Bid (CRTB) is a community rights derived from the Localism Act.

Its purpose is to give communities a right to identify a property that is believed to be of value to their social interests or social wellbeing and gives them a fair chance to make a bid to buy the property on the open market if the property owner decides to sell.

Voluntary and community bodies can make nominations and these include community groups, local parish councils, neighbourhood forums and charities. Successful nominations will be registered as an Asset of Community Value.

So the nomination fails the criteria and test set out in section 88 (1) (a) and (b) of the Localism Act 2011. It is also considered that section 88 (2)(a) of the Localism Act 2011 is not satisfied as the property has not been used in the recent past (which was not an ancillary use) that furthered the social well being or interests of the local community as the property has now been closed since January 2012.
Rose Street Todmorden Todmorden Town Council 25th Jan 2016 The Council deemed that the use(s) identified do not fall within the definition of 'an actual current use that is not an ancillary use'. Although the Council does not have an actual current use for the site, it is suitable for development. As such, any use which the Group seek to rely on by the community can only be an ancillary use. Due to this, the Group has not satisfied the test set out in s88(1).
Lumbutts Methodist Chapel, Graveyard and Fields Todmorden Friends of the Lumbutts Chapel Hole in the Wall 3rd Apr 2014 The Council deemed the actual current use is not an ancillary use and overall the current and future use does not further the social well being or social interests of the local community as per the criteria set out in s88 of Localism Act 2011.
Hole in the Wall, Old Gate Hebden Bridge Friends of the Hole in the Wall 19th Dec 2013 The Council deemed that it was not realistic that in the next five years, that the property could be put to a relevant use as set out under s88 (2) (b) of the Localism Act 2011.
Former Mytholm Works, King Street Hebden Bridge Incredible Edible Mytholm 28th Jan 2013 The Council deemed the use ancillary and not a main use and did not consider it met the criteria set out in s88 of Localism Act 2011.

What is an asset of community value?

  1. It is at least partly within the local authority's area.
  2. Its main use (i.e. which is not an ancillary use) has recently been or is presently being used to further the social wellbeing or social interests of the local community and it is reasonable to think that a non-ancillary use of the asset will further the social well-being or social interests of the local community (whether or not in the same way) do so in the future i.e. within the next 5 years.
  3. It does not fall within one of the exemptions specified in Regulations. These are listed in the Assets of Community Value Regulations .

The CRTB does not apply to residential property or operational land as defined in the Town and Country Planning Act 1990 Part 2.

Who can nominate an asset?

Only voluntary and community organisations with a local connection, so based in Calderdale or a neighbouring authority, can nominate an asset for inclusion on the list. This includes:

  • Neighbourhood Forums
  • Parish Councils
  • Unincorporated bodies of 21 named members
  • A Charity
  • Company Limited by Guarantee
  • Industrial or Provident Society
  • Community Interest Company.

Who makes a decision about whether a nomination is successful or not?

The Council has delegated decision making powers to an officer group, led by the Corporate Asset and Facilities Management (CAFM) Team to review nominations of Assets of Community Value. This group will use the statutory regulations and help in its assessment of information submitted by the nominating group, the owner and any other interested party before reaching its decision.

The nominating group will be informed within 8 weeks of the Council's decision.

What if I, as the property owner, am unhappy with the decision made by the Council?

If the asset owner is unhappy with the Council's decision to list an asset they can request to lodge a review of the Council’s listing decision within 8 weeks of the written notification of listing.

Information will be provided directly to asset owners about how they can do this once they receive notification of the Council’s listing decision.

There is no right of appeal for the nominating group if an asset is not listed as an asset of community value. However, the Council must provide written reasons to that group as to why it has made the decision not to list.
