Rights of way orders

The Rights of Way Team is currently asking members of the public to comment on the proposals listed below.  Proposals may relate to the diversion or extinguishment (closure) of a public right of way. Before commenting on this type of consultation, you may find it useful to refer to Diversions and extinguishments

Most proposals are subject to an informal consultation before the Council makes a formal decision. If you make an objection at the informal consultation stage, the Council will consider this as part of the decision making process.

If the Council then decides to make a legal order, this must be advertised on site, in the local press and to all relevant landowners. If you make an objection at the legal order consultation stage, your objection will be sent to the Planning Inspectorate and they will determine whether the order should be confirmed or not. Please note that an objection made during an informal consultation will not automatically apply to a subsequent legal order, if made.

Once a legal order is made it must be confirmed before it comes into force. The Council can only confirm unopposed orders.The confirmation of an order is advertised in the same way as when the order is made. If you wish to question the validity of a confirmed order, you must apply to the High Court not the Council.

If you wish to support or oppose any of these proposals, please do this in writing quoting the reference given in the notice by the deadline date and clearly state your reasons.

Street closures

The Rights of Way Team also deals with requests to close streets under the provisions of the Highways Act 1980. These follow a different procedure from orders on public rights of way. Where the Council decides to support such a request, an application is made to the Magistrates’ Court in Halifax. Any member of the public is entitled to attend the court hearing and to be heard by the magistrates if they wish.  The Council must therefore give four weeks’ notice of any such application and these are listed below under court applications.

If you wish to support or oppose an application, you do not need to inform the Council but it would be helpful if you did, so that the Council can give the court an idea how long a hearing may be expected to take.

New objections cannot be made at this stage, however members of the public can attend hearings or inquiries if they wish to observe proceedings.
