Transitional additional licensing scheme

Housing Act 2004, Section 59

The Metropolitan Borough Council of Calderdale has been deemed to have declared a Transitional Additional Licensing Scheme that is applicable across the whole area of the Borough. This scheme applies to those houses in multiple occupation that were registered under the Calderdale (Registration of Houses in Multiple Occupation) Control Scheme 1998 and that are not required to have a mandatory licence under section 64 Housing Act 2004 and do not fall under section 257 of the same act. The Transitional Additional Licensing Scheme came into effect 6 October 2006 and will expire after 3 years from that date unless revoked beforehand.

A person commits an offence if s/he is a person having control of or managing an HMO that is required to be licensed but is not so licensed. A person found guilty of such an offence is liable on summary conviction to a fine not exceeding £20,000.
