Street trading

Introduction

The following is for guidance and does not cover the full instructions of the law relating to street trading. If you are in doubt whether you may lawfully trade in the streets of Halifax you should consult your own solicitor.

Regulation of street trading

The Borough Council of Calderdale, under Schedule 4 of the Local Government (Miscellaneous Provisions) Act 1982|External link, has resolved to regulate street trading throughout the town centre of Halifax and street trading is prohibited in most streets within the town centre.

Street trading means 'selling, exposing or offering for sale, any articles in a street'. Exposing for sale is the same as selling and taking orders, or registering members requires consent of the Council. Goods outside a shop, on forecourts which form part of the main business of the shop and of the trader, do not come under the terms of street trading. The subletting of space, even for the same commodities, is street trading and is regulated by the Authority.

Political and Charitable organisations distributing literature do not need consent under the terms of street trading unless they specifically sell or expose items for sale.

A street means any street (adopted or unadopted highway) and also includes areas to which the public have access without payment including car parks, all forecourts, roads, footways and service areas or other areas adjacent to a street, as defined in section 329 of the Highways Act 1980|External link.

A person who:

  • Engages in street trading in a prohibited area; or
  • Engages in street trading in a consent street without being authorised to do so by the Council; or
  • Contravenes any principle condition attached to any Street Trading Licence.

That person is guilty of an offence and on summary conviction shall be liable to a fine.

The following streets in the town of Halifax are designated within the meaning of paragraph 7, Schedule 4 of the Local Government (Miscellaneous Provisions) Act 1982 as follows:

Consent streets

A consent street is where street trading is permitted only with the consent of Calderdale Council and the issue of a licence to undertake street trading, which must be displayed at all times.

  1. Full streets: Bull Green, George Square, George Street, The Square and Woolshops
  2. Sections of streets: Commercial Street (St. John's Lane to Alexandra Street), Wade Street (Northgate to Winding Road) and Wards End (Commercial Street to Horton Street)

Note: Day-time trading shall only take place between the hours of 08.00 and 18.00 (Monday to Sunday inclusive). Night-time trading shall only take place between the hours of 19.00 and 03.00 (Monday to Sunday inclusive).

Food hawkers should note that they are required to register both themselves and any premises they may use for the storage of food intended for sale, with Environmental Services, Northgate House, Northgate, Halifax, HX1 1UN.

All food hawkers keeping their vehicles within the Calderdale Metropolitan District must register with the Local Authority.

Hawkers operating outside the district must register with their own Local Authority and provide proof of registration.

All Hawkers must register with the Local Authority at least 28 days prior to trading.
